Offering a major relief to both home buyers and developers, the Airport Authority of India (AAI) lifted the blanket restriction of 55.10 metres on realty projects within 20km radius from the new Navi Mumbai airport. City and Industrial Development Corporation of Maharashtra Limited (CIDCO) announced that realty projects now can be built upto 160.10 metres (around 48 floors) based on obstacle limitation surface (OLS) specifications by the DGCA and will be given the No objection Certificates (NOC) for the same. AAI is expected to start giving NOCs for projects above 55.10metres height from the first week of August 2022.
“The collaborative teamwork and active support extended by all concerned officials in amicably resolving such a critical technical issue is highly commendable. This citizen-friendly decision will pave the way for the smooth development of Navi Mumbai International Airport, complementing the growth of not just the surrounding NMIA area but the entire MMR region as a whole,” said Dr Sanjay Mukherjee, Vice Chairman and Managing Director, CIDCO.
This decision is a major win for the realty segment in Navi Mumbai which saw a hit since 2018 when the building height cap of 55.10 metres (16 floors) was imposed.
“After the repeated efforts of CREDAI-MCHI to closely pursue the regulatory authorities of CIDCO, NMIAL, the Airport Authority of India (AAI) has ultimately resolved the development of projects closer to the Navi Mumbai Airport. This will help provide a major boost to the sector as housing projects including redevelopment projects which have been in an ambiguous situation for the last 3 years (approx.) will now start receiving CCs and OCs that will help homebuyers steer away from the anomalies restricting the growth in the sector. While the authorisation bodies bolster the demand in the region through its approvals, it would also be important to revise the Colour-Coding Zonal Map (CCZM) to facilitate better clarity to all stakeholders involved,” said Raajesh Prajapati, President and Founder, CREDAI-MCHI (Raigad).
Decisions of blanket cap or limit height approval taken by AAI like now is always the best solution for authorities and developers for ease of doing business in our country clearing the backlog in the direction of development. Dinesh Doshi, managing director, Tulsi Realty said, “The decision of shifting the radar and giving height clearance to an extent is a big relief for developers in Navi Mumbai as the projects bought in CIDCO tender and other authorities were stuck because of the same. We welcome this initiative taken by AAI central government which will now push the development of the Navi Mumbai region at a faster pace.”

Welcoming this decision, Abhishek Sharma, MD Shree Sai Group said, “It comes as a big relief to all the real estate developers. Projects have been unable to take off in the last many months because of such a restriction. There have been huge delays in regular projects and similarly many redevelopment projects have been stuck for lack of height clearance. Now with the removal of restrictions, certainty with regards to height has returned.”
Also, the Civil Aviation Ministry has decided to shift the Airport Surveillance Radar (ASR) 1 to Dhakale Island, DPS Nerul in Navi Mumbai.
Meanwhile, the Bombay High Court on August 25, 2022 has asked the Airports Authority of India (AAI) if the height restriction for buildings in the vicinity of the proposed Navi Mumbai International Airport has been relaxed and directed AAI to respond by August 29, 2022.
A division bench of Chief Justice Dipankar Datta and Justice M S Karnik was hearing a public interest litigation filed by advocate Yashwant Shenoy raising concerns over dangers posed by high rises near the Mumbai airport.
“The AAI shall inform if any clearance or NOC was given till now to any application filed by a developer for construction of a building above the permissible height limit of 55.1 metres. It shall also submit how many more such applications are pending for clearance,” the bench said.
